The General Counsel is responsible for conducting, coordinating, and managing the legal affairs of the College. In addition, the General Counsel provides leadership within the College community for the development, refinement, review, and recommendation of policies and procedures of the College. This position reports directly to the President.
1. Manages all internal and external legal affairs of the College and represents the College before external agencies concerning compliance and regulatory reviews and complaints.
2. Provides and manages the provision of legal and policy advice on College-related issues to the District Board of Trustees, President, and other members of the College staff acting on behalf of the College.
3. Acts as legal counsel for the College in all administrative and court proceedings unless such representation is provided through outside counsel.
4. Under supervision of the President, the General Counsel appoints, supervises and manages the activities of staff and outside legal counsel engaged by the College.
5. Manages and coordinates legal matters involving faculty, staff and students including but not limited to College governance, employment, collective bargaining, intellectual property, real property and construction- related matters.
6. Coordinates the activities of College staff and committees in the conduct of student and employee disciplinary proceedings, grievances and appeals.
7. Collaborates with various campus constituency groups to develop, draft and assist in the implementation of programmatic and policy enhancements consistent with the College’s values, vision, and mission.
8. Supports the College’s Government Relations office in monitoring Federal and State legislative activities that affect the operation of the College. Develops, evaluates and reviews new and existing legislation and legislative initiatives. Identifies emerging higher education issues and develops appropriate responses. Provides counsel in support of local, state and federal legislative matters.
9. Reviews College policies and procedures and drafts such new and revised policies or procedures as required to comply with changes in legislation.
10. Collects, organizes, and prepares legal memoranda, reports and other information as directed by the President.
11. Designs and implements programs to prevent legal issues; serves on College and external task forces and committees.
12. Supervises and directs the work of assigned staff, develops budgets, and the overall strategy for assigned areas of responsibility.
13. Drafts, negotiates and recommends the execution of College contracts and agreements.
14. Manages and monitors litigation and supervises outside counsel retained by the College in all matters brought by or against the College.
15. Interprets and applies relevant federal, state and local legislative and regulatory laws and regulations pertaining to College initiatives.
16. Provides legal opinions and advice on specialized matters including intellectual property, copyright, civil rights, real estate, construction and EEOC, OCR, federal and state regulatory compliance.
17. Coordinates responses to subpoenas/court orders, public records and other requests.
18. Performs other duties as assigned by the President.
1. Juris Doctorate from a regionally-accredited law school.
2. Must be licensed to practice in Florida, or if licensed in another state, must be able to obtain admission to practice in Florida within one year of hire.
3. Substantial or progressive legal experience practicing law and supervising legal professionals for a minimum of 6 years.
4. Experience in making effective decisions and producing results through strategic planning and development, implementation and evaluation of programs and policies.
1. Five-years of experience in the practice of higher education law.
2. Legal experience practicing law with emphasis on labor and employment, related arbitration and administrative proceedings.
3. Administrative/legal experience in higher education at a comprehensive public community/state college.
4. Experience with contract law, employment-at-will, contractual employment, academic freedom and FERPA.

7. In-depth knowledge of Florida Department of Education Statutes.
8. Ability to anticipate, identify, diagnose and consult on problem areas related to legal affairs.
9. Strong computer and presentation skills.

11. Demonstrated ability to create and maintain effective, professional working relationships with key constituents including students, staff and faculty across the multi-campus environment and within the local community.
12. Ability to travel to different campus locations, trainings and community-based events.
WORK ENVIRONMENT AND SPECIAL CONSIDERATIONS:
1. Ability to work flexible hours.
2. Ability to travel both locally and nationally.
3. A valid Florida driver’s license or ability to obtain one within 30 days.
4. Ability to move about campus and to/from multi-campus sites.
This position is not eligible for Veteran’s Preference.
